by submitting my information I agree to the following TERMS & CONDITIONS & INDEMNITY FORM (DISCLAIMER AGREEMENT)

Between Gravity One Climbing and Fitness (PTY), hereafter referred to as Bloc11

And The Climber, or any person entering Bloc11, hereafter referred to as Climber has entered into an agreement in terms whereof Bloc11 has allowed the Climber to make use of its facilities on the terms and conditions below.

The Climber understands that participation in or observing the sport of rock climbing and the use of Bloc11's indoor climbing wall includes certain dangers and risks:

Injury sustained in a fall and hitting the wall, projections (permanent or temporary in place) the floor (including any object or objects resting on the floor).

Injury due to falling climbers or objects.

Cuts and abrasions resulting from bodily contact with the climbing wall.

The Climber further acknowledges that this list is not inclusive of all possible risks and dangers associated with the use of the indoor climbing facility.

The ability of the Climber to climb at Bloc11 gives no indication of his/her ability to climb on natural rock in the outdoor environment.

THEREFORE IT IS AGREED UPON AS FOLLOWS: WAIVER

The Climber acknowledges that the activity in which he/she participates by its very nature is dangerous and carries inherent risks.

Best effort done on the part of Bloc11 staff and owners cannot completely reduce the possibility of such risks. These risks could cause him/her to sustain bodily injury or death and/or suffer damages and the Climber waives any claim however arising against Bloc11 or its members, employees, the body corporate of Island Park or any third party.

DISCLAIMER

The Climber makes use of Bloc11's facilities at entirely his/her own risk. The Climber agrees that Bloc11 will not be held liable and/or responsible for any loss, injury, damages, death, and/or compensation of whatsoever nature and howsoever arising as a result thereof. We will not be responsible for, and shall not pay for, any loss, damage or theft of items left unattended.

MEDICAL FITNESS

The Climber hereby warrants that he/she is medically fit so as to participate in activities of this nature, it not being the responsibility of Bloc11 to have the Climber undergo any medical examination, the onus being on the Climber to do so. Bloc11 shall not be obliged to call upon the Climber to provide a medical certificate. Bloc11, its members or employees, shall not be liable for any claim or injury or loss, damage or even death arising from or in connection with the use of the facility.

COVID-19

Bloc11 has put in place preventative measures to reduce the spread of COVID-19 but is unable to guarantee that you (or your children) will not contract the virus while taking part in activities on the premises. By signing this waiver, the athlete participating in climbing at Bloc11 (or a parent/guardian on behalf of a minor climbing at Bloc11) certifies that he or she is aware that a climbing facility, despite all the precautions being taken, is a potentially risky environment and can result in contraction of the virus. The right of admission is reserved. He or she can be denied entry if presenting non-specific symptoms of COVID-19, regardless of their membership status Participant details.

The email provided here will be used to send the basic information about safety procedures at Bloc11 and in case of future problems with credit card processing. Unless checked below it won't be used for anything else other than changes to terms and conditions.

We'll only ever call you or send you an SMS in case of emergency or problems with your credit card processing.

By checking here, you are consenting to the use of your electronic signature in lieu of an original signature on paper. You have the right to request that you sign a paper copy instead. By checking here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such a copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary.
