INDEMNITY FORM - Terms and Conditions of Participation

By accepting these terms and conditions, you acknowledge that you have read, understood, and agree to the terms outlined in this waiver before proceeding with any activities at Relentless Pty Ltd, trading as CrossFit Relentless Heart, a registered and licensed CrossFit affiliate ("the Gym").

1. Acknowledgment of Risks

I, the undersigned, acknowledge and accept that participation in CrossFit and related activities at Relentless Pty Ltd trading as CrossFit Relentless Heart involves inherent risks, including, but not limited to, serious injury such as muscle strains, fractures, sprains, joint injuries, and other potential physical injuries. I understand that these risks may be increased by my personal physical condition, pre-existing medical conditions, or limitations. I accept full responsibility for my participation and the risks involved.

2. Voluntary Participation

I confirm that my participation in the activities at Relentless Pty Ltd trading as CrossFit Relentless Heart is entirely voluntary, and I am participating of my own free will. I have had the opportunity to ask questions about the activities, and I am satisfied with the answers provided.

3. Waiver and Release of Liability

In consideration of being allowed to participate in the activities at Relentless Pty Ltd trading as CrossFit Relentless Heart, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby fully and irrevocably release, waive, discharge, and covenant not to sue Relentless Pty Ltd trading as CrossFit Relentless Heart, its owners, directors, employees, agents, representatives, or affiliates, from any and all claims, liabilities, demands, injuries, damages, or losses arising out of or in connection with my participation in the Gym's activities, including but not limited to those arising from negligence or otherwise.

4. Indemnity

I agree to indemnify and hold harmless Relentless Pty Ltd trading as CrossFit Relentless Heart, its owners, directors, employees, agents, representatives, or affiliates, from any and all claims, demands, actions, causes of action, or legal proceedings (including reasonable legal costs and expenses), arising out of or in connection with my participation in any activities at the Gym, including any claims resulting from my own negligence or property damage caused by me.

5. Health Declaration

I declare that I am in good health and have no known medical conditions or physical limitations that would prevent me from safely participating in activities at Relentless Pty Ltd trading as CrossFit Relentless Heart. If I have any health conditions that could affect my participation, I will inform the Gym in advance and may be required to consult a healthcare provider before taking part.

6. Emergency Medical Treatment

In the event of an emergency or medical situation, I consent to receive medical treatment as deemed appropriate by attending medical professionals. I understand and accept that I will be responsible for any costs associated with such medical treatment or emergencies while participating in activities at the Gym.

7. Consent to Use of Media

I grant Relentless Pty Ltd trading as CrossFit Relentless Heart permission to take photographs, videos, or other media of my participation in activities at the Gym. I understand that these materials may be used for promotional, educational, or marketing purposes on the Gym's website, social media, advertisements, or other materials. I waive any right to inspect or approve the finished product and agree that I will not receive compensation for the use of these materials.

8. Consent and Signature

By accepting this waiver, I acknowledge that I am consenting to the terms and conditions outlined above. I understand that my acceptance of these terms is legally binding and equivalent to a physical signature, and I am voluntarily entering into this agreement.

9. Governing Law and Jurisdiction

This Waiver and Release of Liability shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from this agreement or my participation in activities at Relentless Pty Ltd trading as CrossFit Relentless Heart shall be subject to the exclusive jurisdiction of the courts of South Africa.

10. Acknowledgment of Understanding and Acceptance

By submitting this form, I confirm that I have read, fully understand, and agree to the content of this document. I acknowledge that by submitting the form, I am giving my explicit consent to the terms and conditions set out herein. I understand that this submission serves as my official and binding agreement, and I confirm that I am voluntarily agreeing to all aspects of this waiver, including the risks, responsibilities, media consent, and legal implications of my participation in activities at Relentless Pty Ltd trading as CrossFit Relentless Heart.
